Until 2 October 2008, the Competition Act 2002 applied a uniform regulatory regime to mergers, with the Competition Authority responsible for applying a substantial lessening of competition test to notified mergers. (There is an exception for media mergers where the Minister for Enterprise, Trade and Employment has been able to apply media plurality criteria to override the Authority acting on purely competition grounds.)
