ESMA Revises Guidelines on AIFMD Reporting Obligations

ESMA has published a revised version of its final report containing guidelines on reporting obligations under AIFMD.  The purpose of the guidelines, which were originally published on 1 October 2013, is to ensure common, uniform and consistent application of the reporting obligations under AIFMD by providing clarification on:

  • The information that AIFMs must report to the relevant National Competent Authorities (NCAs)
  • The timing of such reporting
  • The procedures to be followed when AIFMs move from one reporting obligation to another

Such standardisation is expected to further facilitate exchange of information between NCAs.

Revised versions of the following have also been published on the ESMA website:

  • The consolidated AIFMD reporting template
  • Tables 8 – 10 of Annex II – Change in the AIFM Reporting Obligation (which have been published separately due to their size)

The guidelines will be translated into the official EU languages and published on the ESMA website.  The publication of the translations will trigger a two-month period during which each NCA must notify ESMA whether they comply or intend to comply with the guidelines.
