On 1 December 2010, the Competition Authority published a new Declaration and Notice in relation to vertical agreements. These have immediate effect for new agreements. The Declaration provides a “safe harbour” from the prohibition in Irish competition law on restrictive agreements, subject to compliance with certain conditions, which have been brought into line with the EU position. We will report in more detail on the changes in our next issue of Legal News.
