William Fry Data Protection & Cybersecurity Update 2016

It was a blockbuster year for data protection, privacy and cybersecurity laws. 2015 featured ground-breaking case law and legislative developments. The year ended on a high note with the announcement that the General Data Protection Regulation (“GDPR”) will be adopted by the European Parliament in early 2016 with an estimated enforcement timeline of Spring 2018. The Court of Justice of the European Union struck down Safe Harbor which not only shook the landscape of international data transfers but also opened up a whole new investigation for the Irish Data Protection Commissioner in the Schrems High Court case.

2016 brings more expectation as the final text of the GDPR is due for publication, a solution to Safe Harbor is eagerly awaited and the Facebook investigation is underway.

To mark Data Protection Day, we reflect on some of the key decisions made and guidance issued in 2015 and look ahead to key trends for the year ahead.
