Carol is a highly respected commercial litigator, with particular expertise in intellectual property disputes. She also acts for a number of State Regulators, advising on regulatory disputes.

Recent significant cases include:

  • Advising a large corporation in the food sector on trade mark, design and copyright issues related to consumer products including brand clearance, IP infringement risks and IP enforcement issues.
  • Acting for MSD in the defence of Commercial Court patent infringement proceedings brought by Bristol Myers Squibb / Ono Pharmaceutical / Tasuko Honjo.  
  • Acting for GlaxoSmithKline in its trade mark infringement and passing off action against Rowex Limited (part of the Rowa/Sandoz group) in the Irish Commercial Court relating to one of its biggest selling pharmaceutical products, SERETIDE, a treatment for asthma and COPD. 
  • Acting for Vacaciones eDreams, one of Europe’s biggest online travel agencies, in trade mark infringement, passing off and competition law proceedings before the Commercial Court issued by Ryanair against our client and Google. 
  • Acting for Uniphar (one of Ireland’s largest pre-wholesale pharmaceutical companies owned by community pharmacists) in respect of its defence of trade mark infringement proceedings which have recently been issued before the Irish High Court. 
  • Acting on behalf of ASICS in relation to competition law proceedings for alleged abuse of dominance brought by an Irish retailer Heatons before the High Court Competition list.
  • Acting for ComReg in the defence of a statutory appeal in the Commercial Court taken by Vodafone Ireland Limited in connection with two regulatory decisions taken by ComReg.

Carol is a consultant, external examiner and lecturer in IP at the Law Society School of Education, a member of its Education Committee, Chairperson of the Law Society Curriculum Development Unit, the Law Society Academic Advisory Board and the Law Society Finuas Network. She lectures and writes widely on intellectual property and regulatory law.

Carol was listed in Best Lawyers 2019 under 'The Best Lawyers in Ireland' for work in Biotechnology Law and Intellectual Property Law.
